Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and Instasleb LLC, doing business as TrustyTommy (“TrustyTommy,” “we,” “us,” or “our”). They govern your access to and use of trustytommy.com, the TrustyTommy artificial-intelligence chat experience, related websites, messages, features, subscriptions, and services that link to these Terms (collectively, the “Service”).

Please read these Terms carefully. By accessing or using the Service, you agree to these Terms and acknowledge our Privacy Policy, AI and Safety Disclaimer, Cookie Notice, and any additional terms shown when you activate a particular feature. If you do not agree, do not use the Service.

1. Who may use the Service

You must be at least 18 years old and legally capable of entering a contract to use the Service. TrustyTommy is designed for adults and is not directed to children.

The Service is currently intended for people located in the United States. If you access it from somewhere else, you are responsible for complying with local law, and we do not represent that the Service is lawful, available, or appropriate in every location.

If you use the Service for or on behalf of another person, you represent that you have authority to do so and that you will respect that person’s privacy, choices, and legal rights.

2. What TrustyTommy is

TrustyTommy is an AI-powered general information, creativity, learning, and companionship tool. It can help users ask questions, learn everyday technology, create written or visual content, discuss interests, search for general information, work with user-provided photos, and remember selected details to make later conversations more useful.

“Tommy” is software. Tommy is not a human being, is not conscious or sentient, and does not have personal experiences, feelings, professional credentials, or independent judgment. Friendly or personal language is part of the user experience and must not be understood as a claim that Tommy is a person.

The Service may use automated systems and third-party AI models to generate responses. AI output is probabilistic. The same question may produce different answers, and an answer may be incomplete, inaccurate, outdated, misleading, or inappropriate.

3. Family Care Connection and proposed features

The TrustyTommy Family Care Connection page describes a proposed caregiver-focused concept and potential future features. Unless a feature is clearly identified in the live Service as available, it is not part of the current Service.

Descriptions of potential medication confirmations, caregiver updates, suspicious-message review, family sharing, reminders, or check-ins are illustrations of future development. They are not promises, guarantees, medical monitoring, emergency response, or a substitute for a caregiver, clinician, home-health provider, monitoring service, or emergency system.

The current TrustyTommy Service does not automatically give a caregiver access to a user’s private chats. Any future caregiver-sharing feature will require separate terms, privacy disclosures, appropriate authorization, and user controls before launch.

4. Your identity, device, and account security

TrustyTommy may assign a browser-based user identifier and store it in your browser so the Service can recognize you, continue onboarding, and retrieve saved personalization. You may not receive a traditional username and password.

You are responsible for:

• controlling access to the device and browser you use;
• keeping private any personalized TrustyTommy link sent to you;
• not forwarding a private return link unless you intend the recipient to access the associated experience;
• promptly telling us if you believe another person has accessed your TrustyTommy identity or messages; and
• making sure information you provide is accurate enough for the feature you request.

Clearing cookies or site data, using private browsing, changing browsers, changing devices, or using privacy software may cause TrustyTommy not to recognize you. We do not guarantee that browser-based identity or conversation continuity will always work.

5. Personal information and sensitive content

Your use of the Service is subject to our Privacy Policy.

Do not enter or upload information that is unnecessary for your request, including passwords, Social Security numbers, complete bank or payment-card numbers, authentication codes, government identification numbers, insurance member numbers, or other information that could enable fraud or identity theft.

Do not upload another person’s private information, medical information, image, voice, document, mail, or message unless you have the right and appropriate permission to do so. If you share information about family members, friends, caregivers, or other third parties, you are responsible for respecting their privacy and legal rights.

6. Photos, files, voice input, and other user content

You may be able to submit text, photos, files, voice-derived text, feedback, names, preferences, stories, reminders, or other material (“User Content”).

You retain the rights you already have in your User Content. You grant TrustyTommy and its service providers a worldwide, non-exclusive, royalty-free license to host, store, reproduce, transmit, analyze, modify, and display User Content only as reasonably necessary to operate, secure, support, personalize, and improve the Service; comply with law; enforce these Terms; and protect users and the public.

You represent that:

• you own the User Content or have permission to submit it;
• submitting and processing it will not violate another person’s privacy, publicity, intellectual-property, confidentiality, contractual, or other rights;
• it is not unlawful, deceptive, abusive, or malicious; and
• you will not use the Service to create or distribute content that you do not have the right to use.

Photos and files may be uploaded to and processed by third-party hosting and AI providers. Do not submit intimate images, highly sensitive records, or content you would not want processed by cloud services.

7. AI output and generated content

Subject to applicable law and third-party rights, you may use output generated for you for lawful personal or commercial purposes. To the extent TrustyTommy owns rights in a specific output generated for you, we assign those rights to you upon generation.

AI output may not be unique. Other users may receive similar or identical output. We do not represent that output is copyrightable, non-infringing, accurate, exclusive, or suitable for a particular purpose.

You are responsible for reviewing output before using, publishing, sharing, buying, selling, filing, sending, or relying on it. You must not represent AI-generated material as verified fact or original human work when doing so would be deceptive or unlawful.

8. Prohibited uses

You may not use the Service to:

• violate any law or another person’s rights;
• exploit, deceive, threaten, harass, stalk, abuse, or impersonate a person;
• facilitate fraud, scams, identity theft, phishing, financial exploitation, or unauthorized surveillance;
• request, create, upload, or distribute child sexual abuse material or sexual content involving minors;
• promote or provide instructions for violence, self-harm, illegal drugs, weapons misuse, or other serious wrongdoing;
• obtain or disclose private personal data without authorization;
• upload malware, disrupt the Service, probe security, bypass limits, scrape at scale, or access the Service through unauthorized automated means;
• reverse engineer or attempt to extract source code, prompts, model weights, private system instructions, credentials, or security controls except where law expressly permits;
• use output to make high-impact decisions about another person’s employment, housing, credit, insurance, education, health care, legal rights, or access to essential services without qualified human review and all legally required safeguards;
• falsely claim that TrustyTommy is a licensed professional, human caregiver, medical device, emergency service, government service, bank, law firm, or health-care provider; or
• resell, sublicense, white-label, or commercially exploit the Service itself without our written permission.

We may investigate suspected misuse, preserve relevant information, restrict or suspend access, and cooperate with lawful requests.

9. No professional advice

The Service provides general information and assistance. It does not provide medical, nursing, mental-health, pharmacy, legal, financial, tax, investment, insurance, accounting, engineering, or other licensed professional services.

Do not delay, ignore, or replace qualified professional advice because of something Tommy says. Confirm important information with an appropriate professional and, where relevant, a primary or official source.

10. No emergency or monitoring service

TrustyTommy is not an emergency service and does not monitor users continuously. It cannot reliably detect a fall, missed medication, medical deterioration, abuse, exploitation, suicidal intent, criminal activity, fire, gas leak, or other emergency. Messages may not be reviewed by a human, and a response may be delayed, unavailable, or wrong.

If you believe someone may be in immediate danger or experiencing an emergency, stop using the Service and contact local emergency services or an appropriate qualified professional.

11. Health, medication, and caregiving information

Health-related output is general information only. TrustyTommy does not diagnose conditions, prescribe or adjust medication, confirm that a medication is safe, interpret test results with clinical authority, or establish a clinician-patient relationship.

Medication reminders or confirmations, if offered, are convenience tools only. They do not prove that medication was taken correctly and must not replace instructions from a prescriber or pharmacist.

TrustyTommy is not a covered entity or health-care provider merely because a user discusses health information. Do not assume that information shared with TrustyTommy receives the same protections as information held by a doctor, hospital, pharmacy, or health plan.

12. Scam, fraud, mail, and message review

TrustyTommy may help users look at suspicious messages, mail, bills, websites, calls, or offers. This is a second-look tool, not a fraud guarantee. AI may miss warning signs or incorrectly label legitimate material as suspicious.

Before sending money, sharing credentials, clicking a link, installing software, or providing sensitive information, independently contact the relevant bank, government agency, merchant, family member, or other organization using a trusted phone number or website you locate separately.

13. News, search results, recommendations, and third-party information

Search results, news, prices, availability, schedules, product details, health information, laws, and other current information can change quickly. TrustyTommy may summarize third-party content imperfectly or provide links that later change.

Third-party links, products, and services are provided for convenience. We do not control or endorse them and are not responsible for their content, accuracy, availability, security, or privacy practices. Your dealings with a third party are between you and that third party.

14. Free trials and subscriptions

Some features may be free, limited, trial-based, or paid. The price, billing interval, trial rules, included usage, and material restrictions shown at checkout control over conflicting general descriptions on the website.

If a free trial does not require payment information, it will not automatically become a paid subscription unless you later complete checkout and expressly authorize payment.

When you purchase a recurring subscription:

• you authorize the payment provider to charge the disclosed amount, taxes, and any clearly disclosed fees at the stated interval;
• the subscription renews until canceled;
• you must cancel before the next renewal charge to avoid that charge;
• cancellation stops future renewal and normally leaves access available through the already-paid period; and
• unless the checkout, a written guarantee, or applicable law says otherwise, completed charges are non-refundable and we do not provide prorated refunds for unused time.

We may change prices or plan features prospectively after giving any notice required by law. A price change will not be applied to an already-paid period.

We will provide a reasonably simple way to cancel. Deleting browser data, ignoring messages, or stopping use does not necessarily cancel a paid subscription.

Payments are processed by third-party payment providers. TrustyTommy does not need to receive your complete payment-card number.

15. Text messages and electronic communications

If you separately agree to receive text messages, your participation is also governed by the TrustyTommy SMS Terms. Consent to marketing texts is not a condition of purchasing the Service. Message frequency may vary, and message and data rates may apply.

You may withdraw text-message consent using the instructions provided in the message or SMS Terms. A request to stop promotional texts does not prevent us from sending non-marketing messages that are legally required or necessary to complete a transaction you requested.

You agree that we may provide service notices, receipts, policy updates, and other communications electronically, subject to applicable law.

16. Service limits, changes, and availability

We may impose reasonable limits on messages, images, uploads, searches, storage, or other features. Limits may differ by plan and may change prospectively.

We may add, change, suspend, or discontinue features. We do not guarantee uninterrupted availability, error-free operation, preservation of every message or memory, compatibility with every device, or continued availability of any particular AI model, provider, feature, or third-party integration.

We may perform maintenance and may experience outages, provider failures, data loss, cyberattacks, delays, or errors outside our control.

17. Suspension and termination

You may stop using the Service at any time. Stopping use does not automatically cancel a paid subscription.

We may restrict, suspend, or terminate access if we reasonably believe you violated these Terms, created risk or legal exposure, failed to pay, abused the Service, threatened another person, or used the Service in a way that could harm users, TrustyTommy, or third parties.

Where reasonable, we may give notice and an opportunity to correct the issue. We may act immediately where necessary for safety, security, fraud prevention, legal compliance, or protection of others.

18. TrustyTommy intellectual property

The Service, website, software, design, branding, logos, documentation, and other materials supplied by TrustyTommy are owned by or licensed to us and protected by law.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable right to access and use the Service. No other rights are granted.

“TrustyTommy,” “Tommy,” related logos, and associated branding may not be used in a way that suggests endorsement, affiliation, or ownership without written permission.

19. Feedback

If you send suggestions or feedback, you give us permission to use them without restriction or compensation. This does not give us ownership of your private conversations or other User Content.

20. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL OUTPUT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TRUSTYTOMMY AND ITS AFFILIATES, OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS DISCLAIM ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND QUIET ENJOYMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR NEEDS, PREVENT HARM, DETECT AN EMERGENCY OR SCAM, PRESERVE EVERY MEMORY, PRODUCE ACCURATE OUTPUT, OR OPERATE WITHOUT INTERRUPTION OR ERROR.

Some jurisdictions do not allow certain warranty disclaimers, so some of the above may not apply to you.

21. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUSTYTOMMY AND ITS AFFILIATES, OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OPPORTUNITY; PERSONAL DECISIONS MADE IN RELIANCE ON OUTPUT; OR COSTS OF SUBSTITUTE SERVICES, EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF TRUSTYTOMMY AND THE OTHER PARTIES LISTED ABOVE FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO TRUSTYTOMMY FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED U.S. DOLLARS.

These limits do not apply to liability that cannot legally be limited, which may include certain liability for intentional misconduct, gross negligence, personal injury, or violations of applicable consumer-protection law.

22. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless TrustyTommy and its affiliates, owners, officers, employees, contractors, licensors, and service providers from claims, losses, liabilities, damages, judgments, penalties, and reasonable legal fees arising from your unlawful use of the Service, your User Content, your violation of these Terms, or your violation of another person’s rights.

This section does not require a consumer to indemnify TrustyTommy for TrustyTommy’s own unlawful conduct.

23. Disputes and governing law

Before filing a lawsuit, you and TrustyTommy agree to make a good-faith effort to resolve the dispute informally. A written dispute notice must describe the issue, relevant facts, requested relief, and contact information. Either party may proceed after 30 days if the dispute remains unresolved. This informal process does not prevent either party from seeking urgent temporary relief or filing an eligible small-claims case.

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules. Except where applicable consumer law requires a different forum, claims must be brought in the state or federal courts located in or serving Mercer County, New Jersey, and each party consents to those courts.

Nothing in these Terms waives any non-waivable consumer right.

24. Changes to these Terms

We may update these Terms. We will post the updated version and revise the “Last updated” date. If a change materially reduces your rights or increases your obligations, we will provide additional notice when required by law.

Changes apply prospectively. Your continued use after the effective date means you accept the updated Terms. If you do not agree, stop using the Service and cancel any subscription.

25. General terms

These Terms and the policies incorporated into them are the entire agreement concerning the consumer Service unless separate written terms apply.

If a provision is unenforceable, it will be modified only as much as necessary, and the remaining provisions will continue. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign them as part of a merger, reorganization, financing, sale of assets, or similar transaction.

Headings are for convenience. Words such as “including” mean “including without limitation.” Provisions that by their nature should survive termination will survive, including ownership, disclaimers, liability limits, disputes, and indemnification.
